Open Access and Secondary Publication Right

Investigation on the secondary publication right as a specific author’s right to re-publish and communicate their scientific works to the public
Focusing on Open Access and the Green road to its implementation, we illustrate the secondary publication right in Europe, discussing the legislative models currently in place (by Germany, Austria, the Netherlands, France and Belgium) and the Italian proposal that struggles to become law.
Advancing a provocative suggestion about the personal or moral dimension of such right, we argue that the secondary publication right helps restoring the virtuous circle of academic right by enabling scientific authors to exercise their intellectual freedom and regain their fundamental relationship with the public that is the first recipient and the main funder of their research. We also suggest that such right should be harmonized at the EU level.Are you aware of any of the existing legislative models establishing a secondary publication right?
